Judge Refuses Dismissal, but Dissolves Restraining Order in Mayor Impeachment Case

Farmington, Mo. (KFMO) - Senior Judge Robert Fulton refused to dismiss the case brought by Desloge Mayor Peter Peternak against Alderman John Wigger and the Desloge Board of Aldermen, but dissolved the temporary restraining order granted previously at an injunction hearing held Tuesday afternoon.

Pasternak, who continued to represent himself, claimed the ordinance engaging passed by the Board of Aldermen at the September 9 meeting of the board did not comply with city and state law. Kyle Cronin, special attorney for the board, sought to dismiss the case outright or rendered moot.

Judge Fulton denied the preliminary injunction, claiming that he could not rule based on the current facts. He also dissolved the temporary restraining order granted to Pasternak on August 28. However, Fulton refused Cronin's request to dismiss the case.

The next regular meeting of the Board is scheduled for October 21st.
