(Washington, DC) Missouri's United States Eight District Congressman, Jason Smith, supports the removal of St. Louis Prosecuting Attorney Kim Gardner from office. Gardner is being blamed for 16 year old Janae Edmonson's loss of her legs in an automobile accident caused by a career criminal who was driving a speeding vehicle that struck her while he was out on bond granted by Gardner. The driver of the car, Daniel Riley, who had been charged with First Degree Robbery and Armed Criminal Action, violated the conditions of his parole a total of 104 times before the accident. Smith says Gardner isn't just weak on crime, she is absent on crime.
After being asked to resign, and having that deadline pass with no word from Gardner, Missouri Attorney General Andrew Bailey filed a "quo warranto" suit to have her removed from office immediately. In Missouri Prosecuting Attorneys can't be removed by a Mayor or Governor and they can't be impeached. A judicial process must be used.
